There are many different and important people in a court room, they are referred to as the courtroom work group. These people consist of, the judge, the prosecutor, and the defense attorney. The judge is elected and knowledgeable in the law, and whose main concern is to administer the legal proceedings and offer a final decision. The prosecutor is a lawyer who brings charges against a person. It is their job to explain to the court what crime was committed and to show what evidence has been found to incriminate this person. The prosecutor and plaintiff is not the same person.

The prosecutor is employed by the state to make accusations in criminal proceedings, the plaintiff in the complaining party in a civil proceeding. The defense attorney counsels the accused on the legal process. The accused has the right to make final decisions, including whether to testify, accept a plea deal, or demand a jury trial. It is the defense attorneys job to represent the interests of the client and hold the prosecution to its burden of proving guilt beyond a reasonable doubt. Defense attorney may challenge the evidence presented by the prosecutor and argue on behalf of their client.

In a trial the defense attorney may try to offer a rebuttal to the prosecutor’s accusations. The final determination Of guilt Of innocence is made by a third party. This may be done by a judge, a panel of judges, or a jury panel. The process can differ, depending on the laws of the jurisdiction. In some places the panel is required to give a unanimous decision, while other places only a vote is required. In America, the process depends of the state, court, and agreements made between the prosecutor and the defense.

Other nations do not use juries at all, just military authorities. Offenders are turned over to the correctional authorities, from the courts, after they have been found guilty. The most publicly form of corrections is prison. Prisons may serve as detention centers after the person is found guilty. For containment of the accused, jails are used. Punishment may serve a variety of purposes. The most obvious is to take them from the general public so they cannot perpetrate any other crimes. Prison punishments now offer rehabilitation.
