The government is made up of three branches that were established by the U. S. Constitution: the legislative, executive, and judicial branch. (Chambers & Wedded, 2005). These branches were put In place to make sure the government is effective and citizens’ rights are protected. The legislative branch consist of the House and the Senate which is also known as Congress. The legislative branch makes laws, declares war, regulates interstate and foreign commerce, and controls taxing and spending policies.

The executive branch is made up of the President, his advisors, and other departments and agencies, it is also responsible for enforcing the laws of the land. The Supreme Court and the Federal Judicial center is included in the judicial branch, which creates a new and reshapes old social policies. According to the Constitution “the judicial power of the United states, shall be vested in one Supreme Court, and in such interior Courts as the Congress may from time to time ordain and establish. ” Policy takes the form of a governing principle, plan, or course of action.

Public policy is based on decisions, commitments, and actions made by people who are in authority or affect government decisions. B. C. Cannon’s four basic questions in examining judicial decisions are: (1) whether and in what way new judicial decisions negate earlier legislative acts, (2) the degree to which earlier judicial precedents are altered, (3) determining what specific policy consequences follow from a judicial decision, and (4) how new judicial decisions affect future administrative discretion. (Chambers & Wedded, 2005).

The National Coalition Against Domestic Violence (NAIAD) was organized in 978. According to NAIAD it believes violence against women and children results from the use of force or threat to achieve and maintain control over others in intimate relationships, and from societal abuse of power and domination in the forms of sexism, racism, homophobia, Semitism, anti- Semitism, able-bodying, ageism and other oppressions. There are two laws that has been passed by Congress: the Violence Against Women Prevention and Services Act.

Violence Against Women Act (VIVA) helps the government agencies and victim advocates work together to fight domestic violence. Family Violence Prevention and services Act (PASS) provides federal funding to help victims of domestic violence and their children. The role that the court system or law plays with domestic violence is in the courtroom the judge enforce and interprets existing laws, they also have the ability to establish courtroom policies and procedure for victims safety.

Outside of the court room a judge is a community leader and shapes the community response to domestic violence. Judges are a serious part of coordinated community response. The prosecutor has the authority to decide n the chargers and the judge decides the different penalties. When it comes down to establishing policies and procedures the judge will establish the courtroom police and procedures to better the victims’ safety. The courts policy and procedure can be changed for the sake of making the victim feel safe.

According to Judicial responses to domestic violence courts can create emergency hours, establish multiple location at which victims can file for orders of protection, offer multilingual service’s when necessary, and ensure that the court house and courtrooms are accessible for people with disabilities. According to Local Government Policy-Making Process, policy -making involves several interest, complex analysis, conflicting information, and human personalities.
